Terms of Service

These Terms of Service ("Terms") govern your use of TeaTrade Exchange ("the Platform", "we", "us", "our"), accessible at exchange.teatrade.co.uk. By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About the Platform
TeaTrade Exchange is a simulated virtual trading platform for entertainment and educational purposes. The Platform allows users to trade virtual tea commodities using simulated portfolios.
TeaTrade Exchange is not a financial services provider. We do not offer real-money trading, investment advice, broker-dealer services, or portfolio management. We are not authorised or regulated by the Financial Conduct Authority (FCA) and do not require such authorisation for the services we currently provide. All trading on the Platform is simulated. Virtual balances have no monetary value and cannot be withdrawn, transferred, or exchanged for real currency.
2. Eligibility
You must be at least 18 years of age to create an account and use the Platform. By registering, you confirm that you meet this age requirement. We reserve the right to request proof of age and to suspend accounts where we reasonably believe a user is under 18.
3. User Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You must not share your account with others or create multiple accounts.
- You must provide accurate information when registering.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behaviour.
4. Virtual Trading
- All trades on the Platform are executed using virtual (simulated) funds only.
- Virtual balances, profits, losses, and portfolio values have no real-world monetary value.
- Simulated prices are derived from publicly available historical auction data and market modelling. They do not represent real-time executable prices on any physical or futures exchange.
- Past performance on the Platform (simulated or otherwise) is not indicative of future results in real markets.
- Leaderboard rankings, badges, and achievements are cosmetic features and carry no monetary value.
5. Paid Services & Pricing
The Platform offers optional paid digital services:
- Account Reset (£4.99, one-time) — Restores your virtual trading balance to $10,000.
- TeaTrade Combine Challenge (£49.00, one-time) — Entry to a simulated trading challenge. Successful completion awards a cosmetic "Funded Trader" badge. The badge has no monetary value.
- TeaTrade PRO (£14.99/month, recurring subscription) — Unlocks premium platform features including enhanced social trading tools and chat features.
All prices are in British Pounds (GBP) and inclusive of VAT where applicable. Payments are processed securely by Stripe. We never see or store your full payment card details.
6. Right of Cancellation & Refunds
6.1 Digital Content (Account Reset & Combine Challenge)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel a purchase of digital content. However, by completing a purchase and proceeding to use the service (e.g. your account is reset, or your Combine challenge begins), you expressly consent to the immediate supply of digital content and acknowledge that you lose your right of cancellation once the digital content has been fully delivered.
If you experience a technical error that prevents the service from being delivered (e.g. your balance is not reset after payment), please contact us and we will resolve the issue or issue a full refund.
6.2 Subscriptions (TeaTrade PRO)
PRO subscriptions renew automatically each month. You may cancel at any time through your Stripe billing portal or by contacting us. Upon cancellation:
- You retain access to PRO features until the end of your current billing period.
- No further charges will be made after cancellation.
- We do not offer partial refunds for unused portions of a billing period.
If you cancel within 14 days of your first subscription payment and have not used any PRO-exclusive features, you may request a full refund of that payment by contacting us.
7. Acceptable Use
You agree not to:
- Use automated scripts, bots, or other tools to interact with the Platform without our written consent.
- Attempt to manipulate leaderboards, badges, or trading data through exploits or abuse.
- Harass, threaten, or abuse other users via the chat system or any other feature.
- Use the Platform for any unlawful purpose.
- Attempt to gain unauthorised access to other users' accounts or our systems.
- Post content in the chat that is defamatory, obscene, hateful, or violates the rights of others.
We reserve the right to moderate chat messages, suspend accounts, and remove content at our sole discretion.
8. Intellectual Property
All content on the Platform — including but not limited to the software, design, text, graphics, logos, and data presentations — is owned by TeaTrade or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
9. Data & Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Platform, you consent to the practices described in the Privacy Policy.
10. Disclaimers
- The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not guarantee that the Platform will be uninterrupted, error-free, or free from security vulnerabilities.
- Simulated market data is for educational and entertainment purposes only. We make no representations about its accuracy or completeness relative to real-world markets.
- Nothing on the Platform constitutes financial advice, investment advice, trading advice, or any other form of regulated advice.
- We are not responsible for any real-world trading decisions you make based on your experience with the Platform.
11. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability to you for any claim arising from your use of the Platform shall not exceed the total amount you have paid to us in the 12 months preceding the claim.
- We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
12. Indemnification
You agree to indemnify and hold harmless TeaTrade, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Platform.
13. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the Platform or by email. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. The "last updated" date at the top indicates the most recent revision.
15. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these Terms affects your statutory rights as a consumer under UK law.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
